01 Using miarka

These Terms of Service govern the miarka iPhone app and its website, miarkatracker.com, offered by Steven Szontagh (“we,” “us,” or “our”). By using them, you agree to these terms. If you do not agree, stop using them. Our Privacy policy explains how information is handled.

02 Who can use it

You must be at least 13. If you are under 18, you may use miarka only with permission and supervision from a parent or legal guardian who agrees to these terms on your behalf. miarka is not directed to children under 13. You may not use it where applicable law prohibits your use.

03 General wellness, not medical advice

miarka helps you record protein, view progress, and build a tracking habit. It does not provide medical advice, diagnosis, treatment, clinical monitoring, or personalized nutrition care. Using it does not create a doctor-patient, dietitian-client, or other professional relationship.

Check with a doctor or registered dietitian before starting or changing your diet or relying on a suggested protein goal. This is especially important if you are pregnant or nursing, under 18, taking medication, or have kidney disease, another health condition, or concerns about disordered eating.

Suggested goals are calculations based on your body weight and selected goal type, not an assessment of your medical needs. Points, celebrations, and pet growth are app features, not a reason to eat beyond an appropriate goal. miarka is not an emergency service.

04 Food information and AI estimates

Nutrition values can come from your entries, saved foods, package text, USDA reference data, Open Food Facts, or on-device AI estimates. Labels can change, recognition can misread text, databases may be incomplete, and AI can produce incorrect or unsuitable answers.

Review food identity, ingredients, units, serving sizes, and protein amounts before logging. Verify important information with the original package or a qualified professional. Do not rely on miarka to identify allergens, determine food safety, or manage a medical condition.

Apple Intelligence and on-device dictation depend on device, language, software, and availability. Other logging options remain available if those features are unsupported. We do not guarantee any result or health outcome.

05 Your account and your records

An account is optional for local use. Signing in with any method the app offers enables cloud features and sync. Provide accurate account information, protect your credentials, and tell us if you believe your account is compromised. Do not impersonate others or access an account without permission.

Logging can work offline. Online lookups, cloud sync, and server-confirmed rewards require a connection. Edits can conflict across devices; sync is not a guarantee against data loss. Signing out clears local data after attempting to upload pending changes, and the app warns if those uploads cannot finish.

You retain the rights you have in your entries, meals, photos, and other content. You give us permission to host, copy, process, transmit, and display that content only as reasonably needed to provide, sync, secure, and support miarka, including applicable backups and retention. You must have the right to submit it. This does not transfer ownership of your content to us.

06 Points, pets, and little rewards

miarka awards virtual points for eligible activity, including logs, goal days, and challenges. Points can unlock cosmetic rewards and streak freezes. They have no cash value, cannot be redeemed for money, and are not transferable between people.

Reward rules include limits. Removing or changing a log can reverse points tied to it or affect a current goal or challenge. With an account, the server verifies the balance and reward ownership; an offline display may be provisional until sync finishes.

The current miarka shop spends earned points; it does not sell points, subscriptions, or rewards for real money. We may change available rewards and rules as the app develops. Any future paid offering would disclose its price and purchase terms separately. Your pet is never hungry or sick, and eating beyond the goal does not make it happier.

07 Use it kindly

Do not use miarka unlawfully, infringe someone else’s rights, upload harmful content, misuse another person’s information, interfere with the service, bypass security or reward rules, fabricate activity to exploit points, or attempt unauthorized access.

Do not copy, redistribute, or misuse our software or artwork except as permitted by law or the applicable license. These restrictions do not remove rights granted by open-source licenses or other mandatory law.

08 Apple and other services

miarka uses Firebase for accounts and cloud features, Open Food Facts for product lookups, bundled USDA food data, and Apple device services. Those services and linked websites may have their own terms, policies, and availability. Third-party content and services are not guaranteed to be accurate or continuously available.

For copies distributed through the App Store, Apple’s Standard Licensed Application End User License Agreement governs the app license unless a valid custom license is supplied through the App Store. These terms supplement that license for miarka’s services and website and do not override Apple’s applicable usage rules or your mandatory consumer rights. We are responsible for miarka; Apple is not the operator of our service.

09 Our little world

miarka’s name, branding, character artwork, design, and software belong to Steven Szontagh or their respective licensors. Using miarka gives you permission to use the service under the applicable license, not ownership of those materials. Third-party data, artwork, and open-source components retain their own rights and licenses.

10 Changes and saying goodbye

You may stop using miarka at any time. To delete a cloud account, use Profile → Delete account and complete identity confirmation. Deleting the app by itself does not delete the cloud account. See the Privacy policy for deletion and retention details.

We may update, limit, suspend, or discontinue features, or suspend access for unlawful use, security risks, abuse, or material violations of these terms. Where appropriate and legally required, we will provide notice and an opportunity to address the issue. We cannot guarantee that every device or operating-system version will remain supported.

11 Availability and responsibility

To the fullest extent permitted by law, miarka is provided “as is” and “as available,” without warranties of accuracy, reliability, fitness for a particular purpose, merchantability, non-infringement, or uninterrupted operation. We cannot guarantee nutrition data, generated content, sync, rewards, or integrations will always be correct or available.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits or data arising from use of the service. Our total liability relating to the service or these terms will not exceed the greater of the amount you paid us for miarka during the three months before the claim or $100.

These exclusions and limits apply only where lawful. Nothing excludes liability that cannot legally be excluded, including applicable liability for fraud, gross negligence, willful misconduct, or personal injury, or limits rights that consumer law does not allow you to waive. Apple’s app-license provisions apply to the extent they govern an app-license claim.

12 Claims involving your misuse

To the extent permitted by law, you agree to indemnify and hold harmless Steven Szontagh and any employees, agents, and licensors against third-party claims, losses, and reasonable costs resulting from your unlawful misuse of miarka, infringement through content you submit, or material violation of these terms. This does not apply to claims caused by our own unlawful conduct or to obligations that cannot lawfully be imposed on you.

13 Questions, disputes, and your rights

Please contact us first at hello [at] miarkatracker.com so we can try to resolve a concern. Disputes will be handled under applicable law and in an appropriate forum. These terms do not impose mandatory arbitration or waive your right to bring a claim where applicable law permits.

Nothing in these terms removes rights you have under laws that cannot be waived. If a provision is unenforceable, the remaining terms continue to apply to the extent permitted by law.

14 Updates and contact

We may update these terms as miarka changes. We will update the date above and give additional notice of material changes where reasonably appropriate or legally required. Changes take effect on the stated date or as described in the notice. Continuing to use the service after they take effect means you accept the revised terms, to the extent permitted by law.
